Seminars

FEC seminars can be taught in individual or group sessions. Typically one topic can be covered per half-day, with two topics constituting a full day of training.

Designed to help the trust department managers deal with issues such as due diligence considerations when outsourcing, Board of Directors responsibilities for fiduciary activities, organizing committees to provide effective fiduciary oversight, and how an internal audit can ease a trust department examination.

Fiduciary Law
Analysis of fiduciary principles and the substantive law of trusts, including fiduciary powers, duties and liability as well as regulatory provisions affecting the fiduciary business.

Taxation
Study of taxation issues in a fiduciary context: estate tax, gift tax, generation-skipping tax, and special valuation rules. Case study integrates the various concepts.

Review of the characteristics of trust business. Discussion includes estate administration, types of trusts and agency accounts, as well as guardianships and powers of attorney.

Employee Benefits
Analysis of Qualified Retirement Plans and Non-Qualified Retirement Plans. Tax treatment of distributions is discussed as well as fiduciary responsibilities and prohibited transaction rules.

IRAs
Discussion of Individual Retirement Accounts (IRAs) and their role in financial and estate planning. Analysis of required distributions during the lifetime of the IRA owner, distributions after death of the IRA owner, death before the required beginning date, and death on or after the required beginning date.

Management of Specialty Assets
Analysis of the special responsibilities involved in managing real estate and special assets. Analysis includes: appraisals and inspections, insurance, purchase and sale, rental properties, improvements and repairs, as well as environmental risk issues. An investigation of the risks of administering closely held businesses. Analysis includes valuation techniques, ethical issues, and role of Reg 9.

Compliance
Discussion of the audit function and formal examinations including the trust rating system and the compliance function.
